Alex Wagemann on the importance of expert evidence in arbitration
At the XIX IPA International Arbitration Congress held on April 24 in Lima, Alex Wagemann highlighted the critical role of expert evidence in construction disputes.
Using a case study where poor expert evidence led to a reduced award, he stressed the need for coordinated technical, damage, and quantum/delay expertise.
He advocated for accessible, visually supported expert reports and the use of 3D models and BIM technology to aid understanding.
“Infrastructure has its own language and codes. Without at least basic knowledge of the sector, arbitrators will struggle to interpret evidence and context.”
